Actual Notice

When a person or business actually knows about a dangerous condition or problem (for example, a store gets a report that the floor is wet).

In a personal injury case:
If a property owner had actual notice of a hazard and did nothing, it strengthens a premises liability claim.

What to know:

  • Incident reports, prior complaints, or emails can prove actual notice.

  • Combine with “how long it existed” to show negligence.
