This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our website, tools, and related services (collectively, the “Services“). By using the Services, you agree to this Privacy Policy.

1) Scope & Who We Are

This Privacy Policy applies to personal information processed by Injury Nation in the United States. We control and operate the Services from the U.S. If you access the Services from outside the U.S., you understand that your information may be processed in the U.S. and other countries where privacy laws may be different from those in your jurisdiction.

2) Personal Information We Collect

We collect information in three ways: (A) directly from you, (B) automatically from your device, and (C) from third parties.

A. Information You Provide

  • Contact details (name, email, phone, city/state, preferred contact method).

  • Inquiry details you submit in forms or messages (accident type, brief description of your situation—please do not include confidential or sensitive details you would only share with your attorney).

  • Account information (if you create an account), billing details (for advertisers), firm profile data (for attorneys/law firms), communications and support requests.

  • Reviews and ratings you post (public to other users) and any content you provide.

Note on Health Information: Injury Nation is not a covered entity or business associate under HIPAA. Do not submit protected health information (PHI) you would only share privately with your doctor or attorney. If you choose to include health-related details in a form, we will handle them as personal information under this Policy, not under HIPAA.

B. Information Collected Automatically

  • Usage data (pages viewed, referring/exit pages, time on site, clicks).

  • Device and network data (IP address, browser type, operating system, device identifiers).

  • Cookies & similar technologies for essential operations, analytics, and advertising (see Section 8).

C. Information from Third Parties

  • Analytics and advertising partners (aggregated insights, ad performance).

  • Fraud prevention and security providers.

  • Public sources (e.g., bar directories) to help maintain accurate attorney profiles.

3) How We Use Personal Information

  • Provide and improve the Services (operate the directory, respond to inquiries, maintain accounts, personalize content).

  • Consumer-directed disclosures to attorneys you choose to contact via our forms or tools.

  • Customer service and communications (including service announcements and transactional messages).

  • Advertising and marketing (including interest-based ads, where permitted).

  • Analytics, research, and quality assurance.

  • Security and fraud prevention (detect, investigate, and prevent malicious activity).

  • Legal compliance (complying with law, enforcing our Terms, protecting rights/safety).

4) How We Disclose Personal Information

We may disclose personal information to:

  • Attorneys/Firms you choose to contact. If you submit a form directed to a specific attorney/firm, we disclose your inquiry so they can respond.

  • Service providers & processors (e.g., hosting, payment processing, customer support, analytics, security) under contracts limiting their use to providing services for us.

  • Advertising and analytics partners (see Section 8) for cross-context behavioral advertising and measurement—where required, we treat this as a “share” under California law.

  • Professional advisors (e.g., legal, accounting) and in the context of corporate transactions subject to standard confidentiality.

  • Authorities or other parties when required by law, legal process, or to protect rights, safety, and the integrity of our Services.

We do not sell your contact details to data brokers. When you submit an inquiry to an attorney, that disclosure is consumer-directed and necessary to provide the service you requested. Separately, we may be deemed to “sell” or “share” personal information under certain state laws due to advertising cookies or similar technologies; see Section 7.

5) Your Privacy Choices & Rights

Depending on your location, you may have the right to:

  • Access/know what personal information we maintain about you.

  • Correct inaccuracies.

  • Delete personal information.

  • Opt out of targeted advertising / the “sale” or “sharing” of personal information.

  • Limit use and disclosure of sensitive personal information (where applicable).

  • Data portability (receive a copy in a portable format).

  • Appeal our decision if we decline to act on a request (CO/CT/VA).

How to Exercise Your Rights

Submit a request to [email protected] with “Privacy Request” in the subject, or use our request form (if available) labeled “Privacy Choices.” We will verify your identity (e.g., by confirming access to your email or asking for limited additional information). Authorized agents may submit requests with evidence of authority and, where required, the consumer’s verification. We will respond within the timelines required by applicable law.

Opting Out of Sale/Share & Targeted Ads

  • Use the “Do Not Sell or Share My Personal Information” link (if available) and/or email [email protected].

  • We honor browser-based Global Privacy Control (GPC) signals as an opt-out of sale/share for the browser sending the signal. Some functionality may still require essential cookies.

6) Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Typical retention periods:

  • Account and advertiser records: up to 7 years after account closure (for tax, fraud prevention, and compliance).

  • Inquiry/lead records: up to 3 years from last activity or as required by law.

  • Cookies/analytics data: per cookie lifespan or aggregated/de-identified when feasible.

7) State Privacy Disclosures (U.S.)

California (CCPA/CPRA)

Categories collected (past 12 months): identifiers (e.g., name, email, phone, IP), internet/network activity (usage data), geolocation (coarse), inferences (to personalize), and—only if you submit them—sensitive details (e.g., health-related narrative). We do not use precise geolocation, nor do we knowingly collect data from children under 16.

Sale/Share: We do not sell your contact details to data brokers. Our use of third-party advertising and analytics cookies may be considered a sale or share of personal information under California law. You can opt-out via our Do Not Sell/Share link and through GPC. We do not sell/share the personal information of consumers we know are under 16.

Right to Know/Delete/Correct/Opt-Out: See Section 5. We do not use automated decision-making that produces legal or similarly significant effects.

Limit Use of Sensitive PI: We collect sensitive information only if you choose to provide it in free-text fields and use it to respond to your inquiry; we do not use it to derive characteristics.

Shine the Light: California Civil Code § 1798.83 permits users to request information about our disclosures of certain categories of personal information to third parties for their direct marketing. We do not disclose such information for others’ direct marketing without your consent.

Colorado, Connecticut, Utah, Virginia

We offer the rights described in Section 5 (access/correct/delete/opt-out of targeted advertising). For appeals, email [email protected] with “Appeal” in the subject. We will respond within the required timeframe and include how to contact your state attorney general if you remain dissatisfied.

Nevada (NRS 603A)

Nevada residents may opt out of the sale of “covered information” by emailing [email protected] with “Nevada Opt-Out” in the subject line.

8) Cookies & Similar Technologies

We use:

  • Strictly necessary cookies (security, fraud prevention, and enabling core site features).

  • Analytics cookies to understand site usage and improve the Services.

  • Advertising cookies to show relevant ads and measure performance.

You can control cookies through our consent banner (where available) and your browser settings. Blocking some cookies may affect site functionality. We may use web beacons, pixels, and local storage for similar purposes.

9) Data Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information. However, no system is perfectly secure, and we cannot guarantee absolute security. If a data incident occurs, we will take steps required by law to notify you and remediate.
