Failure to use reasonable care under the circumstances, resulting in harm to another person.

In a personal injury case:
To prove negligence, you usually must show:

  1. The defendant owed you a duty of care (for example, to drive safely).

  2. They breached that duty (speeding, distracted driving, unsafe property).

  3. The breach caused your injuries.

  4. You suffered legally recognized damages (medical bills, pain, etc.).

What to know:

  • Many everyday accidents are negligence cases—car crashes, slip and falls, dog bites, and more.

  • Evidence like photos, video, witness statements, and medical records are key.
