Arbitration

A private dispute resolution process where a neutral third party (the arbitrator) hears both sides and makes a decision. It can be binding (final) or non-binding (advisory).

In a personal injury case:
Arbitration may be required by certain insurance policies or contracts, such as UM/UIM coverage disputes or medical provider contracts.

What to know:

  • Arbitration is usually faster than a full trial.

  • Rules of evidence are often more relaxed.

  • If the arbitration is binding, appeal options can be very limited.
