Duty of Care

A legal obligation to act with reasonable care to avoid harming others.

In a personal injury case:
Drivers owe a duty to drive safely. Property owners owe a duty to keep their premises reasonably safe for lawful visitors, and so on.

What to know:

  • Many cases turn on whether a duty existed and what was “reasonable” under the circumstances.

  • Professional duties (like doctors) can be higher than those of ordinary people.
