The obligation to prove the elements of your claim to a certain legal standard.

In a personal injury case:
The plaintiff usually must prove their case by a preponderance of the evidence (more likely than not).

What to know:

  • You don’t have to prove your case “beyond a reasonable doubt” (that’s the criminal standard).

  • Good documentation and credible testimony are key to meeting your burden.
