When a person or business should have known about a dangerous condition because it existed long enough or was obvious.

In a personal injury case:
Stores often claim they didn’t know about a spill; constructive notice argues they should have known and fixed it.

What to know:

  • Surveillance footage, employee schedules, and inspection logs help show constructive notice.

  • The longer a hazard exists, the stronger this argument gets.
