Hazardous Condition

A dangerous property condition that can cause injury, such as a wet floor, broken handrail, uneven pavement, or poor lighting.

In a personal injury case (premises liability):
You generally must show the owner knew or should have known about the hazard and failed to fix it or warn about it.

What to know:

  • Photos and witness accounts are crucial because conditions may be repaired quickly after an incident.

  • Incident reports from businesses can also be helpful evidence.
