Third-Party Claim

A claim against someone other than your own employer or insurer who caused your injury.

In a personal injury case:
For example, a driver injured at work may have both workers’ comp and a third-party claim against the at-fault driver.

What to know:

  • Third-party cases can significantly increase total recovery beyond work comp benefits.

  • Work comp insurers may assert liens on third-party recoveries.
