Strict Liability

Liability that doesn’t require proof of negligence, usually for inherently dangerous activities or certain defective product claims.

In a personal injury case:
Dog bites, product defects, and ultra-hazardous activities can be strict liability in some jurisdictions.

What to know:

  • You still must prove causation and damages.

  • The key is that you don’t have to prove the defendant was “careless.”
